RAJASTHAN ALLOWS SLAUGHTER OF BUFFALOES BY AMENDING SECTION 2 OF RAJASTHAN BOVINE ANIMAL PRESERVATION ACT 1995- UNETHICAL, UNCONSTITUTIONAL AND AGAINST PUBLIC INTEREST
By an Amendment Bill 2018 the Legislative Assembly of Rajasthan has amended section 2 of the Rajasthan Bovine Animal (Prohibition of Slaughter & Regulation of Temporary Migration or Export) Act 1995 to allow freely the slaughter of all types of buffaloes including milking pregnant, calves, drought useful for agriculture and breeding. This will be a black day in the history of Government of Rajasthan to kill the millions of buffaloes unfettered by any law and will bring a halt to the white revolution, blow to the farmers, availability of milk, hamper the growth of non-conventional energy means, ecological balance, rural economy, health of public, availability of natural dung, spoiling the fertility and health of the soil.

The Government is heading towards gruesome cruelty by above decision to kill innumerable dumb, Hapless and speechless innocent buffaloes who fed the citizens of entire country with 80% nutrient milk and sustained the growth of country and its citizen and always stood as a true friend. The decision has utterly abrogated the soul of Article 51A (g) of the Constitution of India which reads as follows:
“It is the duty of every citizen to protect and improve the natural environment including forest, lakes, rivers and wild life, and to have compassion for living creatures”.
It may be gainfully mentioned that both the bovine species Cow and Buffalo are inter related and in actual practice, it will encourage slaughter of cow progeny due to fact that prices of Cows and Buffalo beef are interconnected and dependent due to market conditions economic viability for export purposes. Cow beef is illegally exported in the guise of buffalo meat. Why beef is exported illegally because there is no ban on buffalo meat export and same is all the more now encouraged.
In 1995, the then State government has enacted the above Act of 1995 with avowed Aim and object of curbing the slaughtering of cow & buffalo progeny. The Aim and object reads as follows:
“With the growing awareness of non-conventional energy sources like bio-gas the necessity of dung of these bovine species has gained further importance in addition to its utility as manure and as a fuel for the rural population. Such cattle even when they cease to be capable of yielding milk or breeding or working drought cattle can no longer consider as useless”. “In order to protect and improve the natural environment by minimizing dependence on chemical fertilizers and pesticides and by using natural & soil friendly manure generated by these bovine animals the slaughtering of these animals needs to be strictly prohibited”.
“UTTER DEFIANCE OF ARTICLE 48 OF THE CONSTITUTION OF INDIA”
The State Government is heading towards violating the Directive Principles enshrined in the Article 48 of the Constitution of India which directs that the State shall in particular take steps for preserving and improving the breeds and prohibiting slaughter of cows and calves and other milch and drought cattle. To implement and enforce the Directive principle of our Constitution, the then State Government enacted the above Act prohibiting the slaughter of milch and drought cattle which means and includes buffaloes. Now it is unfortunate that the present Government who is committed to uphold our great heritage and culture, chose to allow killing of buffaloes.
The decision of the Government violated the spirit of judgment of Honorable Supreme Court of India in the case of State of Gujarat v/s. Mirzapur Moti Kureshi Kasab Jamat and others in Civil Appeal no. 4937 of 2005.The importance of Article 48 is emphasized by honorable court in above case. Court observed “that they (Article 48) are nevertheless fundamental in the governance of the country. They further observed that directives principles play a significant role. The reasoning is further strengthened by article 51-A(g) of the Constitution. The state and every citizen of India must have compassion for living
creatures. The cattle which has served human beings is entitled to compassion in its age when it has ceased to be milch become drought and so called ‘useless’. It will be an act of irreprehensible ingratitude to condemn a cattle in its old age as useless and send it to slaughter house taking away a little time from its natural life that it would have lived. forgetting its service to the major part of his life for which it had remain milch or drought”.
Most States have ban on Slaughter of Buffalo:
It may be gainfully mentioned that many states namely Tamilnadu, Andhra Pradesh, Telangana, Karnataka, Gujarat, Madhya Pradesh, Bihar, Jammu and Kashmir, Assam, Chhattisgarh etc have a ban on slaughter of useful buffaloes in furtherance of Article 48 of the Constitution of India.
The removal of ban on slaughter of buffaloes would give a big relief to the buffalo meat producers and traders as reported in TOI Newspapers will encourage theft of buffaloes, slaughter of Cow and its progeny in the guise of buffalo, slaughter of all types of useful buffaloes, open gates for establishing the buffalo slaughter houses in Rajasthan, adversely affect the milk production, create shortage of much needed natural dung fertilizer, renewable energy, encourage adulteration of milk, increase prices of milk and its products, encourage export of meat, indiscriminate slaughter of buffaloes resulting in extinction of rare breeds, effect the farmers livelihood, earnings of poor milk vendors, dairy farming, spoil the soil fertility, encourage use of chemical fertilizers, create ecological imbalance, encourage farmers suicide adversely affect rural economy, and transportation and will result in depletion and destruction of cattle wealth of the country for which Honorable Supreme Court has already expressed its anguish and gave directions for review of Meat export policy.
In its judgment dated.29-3-2006 in the case of Akhil Bharatiya Goseva Sangh Vs. State of A.P. & Others in Civil Appeal No. 3967/94 the apex Court directed:
“Finally, the Central Govt. is directed to review the meat export policy, in the light of the Directive Principles of State Policy under the Constitution of India, and also in the light of the policy’s potential harmful effects on livestock population, and therefore on the economy of the country”.
Already there is heavy shortage of milk and its prices are unaffordable to a common man which prompted unscrupulous elements to resort to adulteration of milk, khowa, kalakand, curd, yogurt, sweets, ghee etc. 70% of the milk in the country is already adulterated as per Union Ministers statement made in Parliament. Honorable Supreme Court took a serious note on this problem and directed to take strict steps. Every day adulteration cases are reported in the news papers. Criminal cases are booked but they are tips in the ice berg. When Shortage of milk resulting in its high
prices is created by indiscriminate slaughter of Cattle (both milking and drought bovine species), it is next to impossible to curb the adulteration. This amendment will add fuel to the fire. In proportion to human population the bovine population is declining steeply, causing ecological imbalance which can never be replenished.
By such decisions our heritage and culture enshrined in Article 51A (f) in the land of Mahatma Gandhi, Lord Rama, Lord Krishna, Bhagwan Buddha and Mahavira will be highly disrespected and insulted. Such type of decisions to kill the bovine animals like buffalo is nothing but an inhuman, unsocial act and reminds us of primitive wild society.
Maharashtra Animal reservation Act amended in 1995; section 6 of this Act restricts the slaughter of buffaloes.
Similarly section 3 of Bihar preservation of Animals Act 1955 prohibits the slaughter of Buffaloes.
Similarly section 5 of Assam cattle preservation Act 1950 prohibits the slaughter of Buffaloes.
Similarly section 6 of A.P. Prohibition of Cow slaughter Act 1977 prohibits the slaughter of Buffaloes likewise, many other states also.
The Central law, Prevention of Cruelty to Animals Act 1960 read with very recent Rules called as Prevention of Cruelty to Animal (care and maintenance of case property Animals) Rules 2017 defines cattle means a bovine animal including bulls, cows, buffaloes steers heifers and calves and includes camels.
A new law called Prohibition of Slaughter of Camels is enacted in 2015 by Rajasthan Govt. as in the absence of any law, the camels were slaughtered indiscriminately and its population drastically declined and becoming extinct. Now with this proposed amendment the buffaloes will also end their life in slaughter houses as Camels were in the absence of any Law.
Representation has been made to Government of Rajasthan to withdraw the said amendment and make necessary amendment on par with other State Laws so as to prohibit the slaughter of milch, drought buffaloes (cattle) as directed under Article 48 of Constitution of India.
The Rajasthan Government deserves appreciation for amending the law by inserting section 6 A in the above Act 1995 to equip itself with the powers of confiscation of means of conveyance used in the commission of offence under the Act and further inserting section 12 A to authorise competent authority or other person to arrest any person who is involved in the commission of offence punishable under this Act.
